英業達年底裁員50人 員工怒:還我年終跟職福金!

《蘋果》讀者爆料,英業達集團旗下位於承德路166號的「英冠達」預計今年年底大裁員
,只留下20人左右,負責收尾財務和業務單位,計劃2017年公司會結束清算,被資遣員工
投訴拿不到年終跟職福金,本報向勞工局查詢,勞工局給予英冠達員工兩個辦法。
英冠達成立7年,原本有300多人,負責開發AIO,現在負責惠普的團隊約90人已經挪回英
業達總部,剩餘團隊陸續資遣,現在只剩不到70人,本周又有一波資遣,預計到年底只剩
20人,員工抱怨,英冠達在11~12月裁員,除了按年資比例來發資遣費外,年終竟然一毛
不給,只有留下來收尾的員工,公司才會發予年終,相當不公平。
另外,員工也抱怨,公司福委會的福利金,是所有員公薪資繳納出來的,他認為目前還剩
800多萬元,公司也沒有對如何處理多做說明,只說會在公司結束時進行清算,該員工抗
議:到時是由留下來的高階主管來分全部福利金款項嗎?
對此,台北市勞工局表示,應該看該公司福委會制訂辦法辦理,若有制訂「離職慰問金辦
法」,就可以發放給現在離職員工慰問金,若沒有制訂,現存福委會也可立刻制訂。
勞工局表示,根據職工福利金條例第九條之一第一項規定,如業務緊縮或歇業大量裁減員
工,基於考量照顧非自願性離職職工福祉,該公司職工福利委員會可本公平、普遍原則訂
定相關退(離)職慰問辦法報主管機關備查後,據以辦理。
而對員工抗議福利金金額累積高額資金,勞工局表示,福委會福利金每年必須支出至少
60%,多數企業100%使用完畢,所以應該沒有上年度累積過多資金問題,至於清算時福利
金發放方式,應由資方跟福委會「從寬認定」最後員工的在職期限,不必限到最後一日仍
上班員工才適用,尚未到清算日,福委會也可制訂發放名冊,保障員工權益。
而對12月被資遣領不到年終,勞工局說,根據勞基法第二十九條,企業有盈餘應該發放給
員工獎金,但該獎金不包括年終,年終屬於雇主恩惠性給予,以七十八及七十九條規定來
說,年終不發放沒有罰則。
不過,很多企業員工有跟雇主簽訂保障年薪14個月之類的勞動合同,此時2個月就是意味
年終,勞工局表示,若有簽署這類合約,員工可以到勞工局辦理「調解申請」,由於已經
到12月才非自願被解雇,有爭取年終發放權利。該申請書可到勞工局櫃臺或網路下載填妥
寄回,約3週就會通知雇主跟勞工到市府協調。(王郁倫/台北報導)
